Tax Code reform: firm deadlines for your tax claims

On October 6, 2026, Ecuador's National Assembly approved the reform to the Tax Code. It sets 120 business days to resolve tax claims, makes the admission of review requests mandatory (maximum 180 days) and calculates fines on the basis of the basic wage. The reform still awaits action by the Executive and publication in the Official Registry.

Real matters, told with discretion.

We describe each matter without names or details that could identify our clients.

Employment · Textile industry

Labor compliance under control

The challenge
Keeping the company's labor obligations up to date amid frequent regulatory changes.
What we did
A compliance matrix with alerts by obligation and deadline, updated through periodic regulatory review.
Litigation · Debt claims

Defense in a summary debt-collection suit

The challenge
A financial institution sued on a promissory note, with a debt calculation it had prepared unilaterally.
What we did
We challenged the formal validity of the instrument and proposed a payment formula limited to principal and statutory interest.
Corporate · Cooperative finance sector

Setting up a savings fund

The challenge
Meeting, from scratch, the requirements of the Superintendency of Popular and Solidarity Economy.
What we did
Founding charter plus credit, deposit-taking and anti-money-laundering manuals.
Employment · Appeals

Defense in a labor appeal

The challenge
Responding to the opposing party's appeal in a labor lawsuit.
What we did
A response grounded in labor law and in the case law of Ecuador's National Court of Justice.
Common situations

Problems we solve often.

Illustrative examples of matters we handle. They do not describe any particular client.

Corporate · Foreign investment

A foreign company enters Ecuador

Choosing between a branch and a subsidiary, setting it up before the Superintendency of Companies, registering the investment and appointing a legal representative with the right powers.

Contracts · Suppliers

A contract with a strategic supplier

Reviewing penalties, guarantees, confidentiality and the arbitration clause before signing, so the contract protects the business and not just the relationship.

Employment · Terminations

Ending an employment relationship without liabilities

Calculating severance, choosing the right legal route and registering the settlement before the Ministry of Labor and Human Development to close off the risk of claims.

Compliance · Personal data

Complying with the Data Protection Law

Mapping data processing activities, updating notices and policies, putting consent in order and deciding who takes on the data protection officer role.

Corporate · Governance

Putting the house in order before growing

Updating bylaws, corporate books and appointments; handling the entry of a new shareholder or a capital increase with documents in order.

Litigation · Collections

Recovering overdue receivables

Assessing the available instruments, first attempting a documented negotiation and, if it fails, filing the appropriate summary or payment-order proceedings.
